Enara is offered from Germany. This English version is provided for your convenience. In case of any dispute, the German version at getenara.app/agb.html is the legally binding one.
1. Provider and scope
The provider of the Enara app is Jakov Brekalo (sole proprietorship), Schwanenplatz 3, 93047 Regensburg, Germany (referred to below as "we"). These terms apply to your use of the app and its features.
2. What Enara provides
Enara is an app for journaling, rituals and a personal conversation with an AI companion. We make the app and its features available in their current scope. We do not owe a particular feature set or uninterrupted availability. We keep developing the app.
3. Important: this is not medical or therapeutic treatment
Enara is a tool for self reflection and wellbeing. Enara is not medical treatment, not psychotherapy and not a replacement for professional help. The content and the answers of the AI companion are not a diagnosis and not a treatment. In a crisis or with health complaints, please turn to a doctor or a licensed therapist. In the United States you can reach the 988 Suicide and Crisis Lifeline by calling or texting 988, and 911 in an emergency. In Germany the Telefonseelsorge is available free of charge around the clock at 0800 111 0 111, and the emergency number is 112.
4. Account
An account is required to use the app. You are responsible for keeping your credentials secret. Signing in through Google or Apple is also possible.
5. Subscription, free days and cancellation
- Certain features are part of the paid subscription "Enara Plus".
- Every new account gets 3 free days with full access. No payment data is needed for that. After the free days the app automatically moves to the free basic version. A paid subscription only comes about through an active purchase in the store, never automatically.
- Purchase and billing of the subscription run through Apple's App Store or Google Play. Their terms apply in addition. For purchases through the App Store, Apple's standard end user license agreement (EULA) applies as well: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
- Enara Plus comes in two terms: monthly (1 month) and yearly (12 months).
- The subscription renews automatically for the chosen term unless it is cancelled at least 24 hours before the end of the current period. Cancelling and managing the subscription happens in the settings of your App Store or Google Play account.
- Current prices are shown to you before purchase, in the app or in the store. Your store account is charged when you confirm the purchase.
6. Right of withdrawal for digital content
When you buy digital content that is made available immediately, your statutory right of withdrawal expires once you expressly agree that we begin performance before the withdrawal period ends and you confirm that you thereby lose your right of withdrawal (Section 356(6) of the German Civil Code). Refunds are additionally handled according to Apple's and Google's rules.
7. Your obligations and use
You use Enara for personal purposes. You undertake not to enter unlawful content and not to use the app abusively or disruptively.
8. Your content
The content you enter remains your content. We process it solely in order to provide you with the features of the app (see the privacy policy).
9. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For simple negligence we are liable only for the breach of an essential contractual obligation, and limited to the foreseeable damage typical for this kind of contract. Beyond that, liability is excluded. Liability under the German Product Liability Act remains unaffected.
10. Changes to these terms
We may adjust these terms, for example as the app develops or when the legal situation changes. We will inform you of material changes in an appropriate way. The version available in the app at the time applies.
11. Applicable law and place of jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
